David Stone oversees the firm’s false claims litigation practice area.

Since joining the firm as a partner, Mr. Stone has headed up the trial team which recently obtained a $163 million settlement on behalf of the Government and the firm’s client Relator against Medco Pharmaceutical Corporation and is handling numerous additional False Claims Act cases venued throughout the country both sealed and unsealed. In addition, Mr. Stone recently concluded the successful defense of a number of well-known New Jersey companies in a civil price-fixing class action and related criminal investigation, is defending several Fortune 500 companies in ongoing securities litigations, is representing several Fortune 500 companies in intellectual property litigations, and is representing various corporations and high net individuals in complex commercial litigations pending throughout the United States.

Prior to joining the firm, Mr. Stone was a founding name partner of the firm Freedman & Stone and a founding partner of the firm Stern & Greenberg with the former, Honorable Herbert J. Stern. In his years prior to joining the firm, Mr. Stone was involved in numerous complex trials and appeals in both federal and state court. Among the matters in which Mr. Stone participated were the appeal in State of Rhode Island v. Claus Von Bulow, the defense of W.R. Grace in City of Woburn v. W.R. Grace, et al., the representation of the Estate of Doris Duke and various litigations pertaining to the probate of that Estate, a successful multi-million dollar malpractice action in the State of Minnesota; a successful multi-million dollar Medicare False Claims Act action in the State of Minnesota, serving as lead counsel in the defense of a class action against 28 temporary technical service firms by the California Pension Fund and numerous successful appeals on behalf of Fortune 500 companies, various trade associations and individuals. Mr. Stone also served as special appellate counsel to The Medical Society of New Jersey and Hertz Claims Management Corporation and currently also serves as special antitrust counsel to The Medical Society of New Jersey and, in that capacity, is responsible for drafting legislation and regulations to implement the Joint Negotiations Law permitting physicians to negotiate with health maintenance organizations.

Previously, Mr. Stone served as outside General Counsel of YankeeNets, LLC where he was co-trial counsel with David Boies in a successful suit to recover the New York Yankees' television rights from Madison Square Garden Network.

Mr. Stone has been a guest speaker and panelist in numerous seminars, including seminars conducted for the benefit of the American Association of Nurse Anesthetists, the Minnesota Association of Nurse Anesthetists, the Medical Society of New Jersey and the Medical Society of Colorado. Mr. Stone also participated in the presentation of testimony on antitrust and healthcare before Congressional Subcommittee on Antitrust and Healthcare.
