Lisa Nousek's primary area of practice is complex civil litigation, including product liability litigation. She has represented clients in state and federal trial and appellate courts in matters involving various substantive areas of law.
Ms. Nousek has been on the trial team for a number of different cases including:
- Defense of Pfizer in multi-district proceedings involving claims that an antiepileptic drug it manufactures causes suicide. In the first such case to go to trial, the plaintiff dismissed its claims shortly after opening statements.
- Defense of American Express in the first phase of the bench trial of a nationwide consumer class action seeking over $500 million for alleged unfair business practices, breach of contract and conversion in connection with travel insurance services offered to cardmembers. The Court entered judgment in favor of American Express on all claims and ordered the class representatives to pay almost $400,000 in costs.
- Representation of a thoroughbred owner who brought claims against her business partner for breach of fiduciary duty, fraud and conversion in a case concerning the undisclosed sale of syndicate shares and breeding rights in leading thoroughbred stallions. After an eight-day trial in federal court in Las Vegas, the firm's client obtained a jury verdict, along with $1.6 million in punitive damages. When the trial court reduced the jury's punitive damages award by almost half, Ms. Nousek represented the client in a successful appeal before the Ninth Circuit, which reversed the trial court's reduction order.
Other representative matters include the defense of a big-four accounting/auditing firm against securities fraud claims brought in connection with the exposure of fraud at a corporation for which the Firm's client had served as auditor; litigation concerning the non-payment of a finder's fee in connection with the acquisition of a preeminent NFL franchise; and the pro bono representation of a disabled veteran against his landlord.
In 2005, Ms. Nousek received an award from the Food and Drug Law Institute for her article entitled Industry Self-Regulation of Direct to Consumer Prescription Drug Advertising: Promoting Consumer Knowledge and Safety.
