Joseph F. Kroetsch’s main practice area is high-risk commercial litigation, particularly where the matter involves the strategic management of the client’s reputation with the public, the media, and government.  He has represented and advised some of the world’s largest corporations and financial institutions in diverse matters involving cutting-edge commercial law, securities, consumer protection and reputational issues. 

Most recently, Mr. Kroetsch played a leading role in the firm’s representation of Herbalife Ltd. in several matters, including the defense and settlement of a nationwide class action based in California federal court. Mr. Kroetsch was also part of a Boies, Schiller & Flexner trial team in New York federal court litigating a multi-billion dollar breach of contract lawsuit arising out of a high-profile health care industry merger.

Some of Mr. Kroetsch’s recent work includes:

  • Representing Herbalife Ltd. in different matters arising out of highly publicized allegations made against the company by the hedge fund and short seller Pershing Square Capital Management, including defending the company in connection with a nationwide class action based in California federal court claiming violation of consumer protection laws;
  • Representing one of the world’s largest gaming companies in a dispute with a news organization publishing defamatory articles in apparent coordination with client competitors;
  • Representing one of the world’s largest financial institutions to recover investment losses through securities and financial litigation;
  • Representing a major multinational medical device manufacturer in multi-billion dollar litigation arising from the alleged breach of a merger agreement’s “no-shop” provision;
  • Representing large trust services providers in litigations relating to billions of dollars of mortgage loan repurchases;
  • Representing several film production studios in different litigations relating to contractual claims arising out of license agreements;
  • Representing international banks in connection with disputes regarding collateralized debt obligations; 
  • Representing a prominent fashion designer in litigation in Delaware Chancery Court in connection with claims that a former partner misappropriated her company’s intellectual property;

Represented a private equity firm and related entities in litigation in Delaware Chancery Court against the founder’s former partners and employees
