Michael Jay’s practice primarily involves intellectual property litigation and strategy, with a specific focus on patent and trade secrets litigation.  He has represented a broad range of clients, including in jury and bench trials, in cases involving such diverse technologies as telecommunication protocols, smartphones, integrated circuits, computer software, blade servers, ethernet controllers, medical devices, and biological products.  Mr. Jay also has substantial experience in other complex litigation, including trademark, copyright, antitrust, and California Business and Professions Code section 17200 claims.  He has litigated high-stakes cases in courts throughout the United States, as well as the U.S. International Trade Commission. 

Some of Mr. Jay’s recent achievements include:

  • Secured a permanent injunction on behalf of a leading fabless semiconductor company in a multi-patent suit following a successful verdict at trial;
  • Defended the world’s largest semiconductor chip maker against patent infringement claims involving blade server technology;
  • Represented a global smartphone manufacturer in a sixteen-patent infringement matter involving user-interface, digital-image, and call-functionality technology;
  • Defended California’s largest utility against the biggest class action antitrust lawsuit in California history in terms of alleged damages;
  • Defended a multinational bank against patent infringement claims involving online banking software technology;
  • Defended a global business process outsourcing company against patent infringement claims involving call center technology;
  • Prosecuted patent infringement claims on behalf of a major cosmetics manufacturer involving home microdermabrasion technology;
  • Defended an automobile manufacturer against allegations of antitrust violations in connection with the export of foreign vehicles into the United States;
  • Defended a social networking service against a multinational music company in litigation involving claims of copyright infringement.
