U.S. District Judge Jacqueline Scott Corley of the U.S. District Court for the Northern District of California denied Structure Therapeutics Inc.’s motion to compel arbitration in the suit filed by BSF client Ding Ding, Ph.D., who alleges she experienced discrimination, harassment, and retaliation while working as the company’s chief financial officer.
Ding alleges she was fired in 2022 after facing gendered criticism and insensitivity from her boss after she was the victim of domestic violence. Judge Corley ruled that Dr. Ding sufficiently pled sexual harassment claims under California and New York law and properly invoked her rights under the 2022 Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act, which allows victims to invalidate arbitration agreements in cases involving sexual assault or sexual harassment.
