Boies Schiller Flexner partner John Kucera was featured in an AmLaw Litigation Daily article, where he spoke about shifting priorities in white collar crime enforcement.
As state and local law enforcement agencies potentially fill the gaps created by different priorities at the federal level, John, a former federal prosecutor, and other white collar practitioners discussed some of the challenges those agencies will face. As it relates to activity that is most commonly prosecuted at the federal level, John noted "It is going to be hard in many cases for non-federal prosecutors’ offices to ramp up and be able to take a lot of the mandate to charge these types of crimes that had been sort of reserved for federal prosecutors.”
John also flagged resource allocation and competing priorities with regard to local criminal enforcement as factors that create challenges for prosecutors.
