As part of several actions being handled by the firm in connection with Modell’s Sporting Goods, BSF filed a shareholder derivatives suit on behalf of Shelby Modell and the company on June 9, 2011, in New York State Supreme Court. The complaint alleges that Mitchell Modell, CEO of the company and son to Shelby and the late Bill Modell, has been routinely engaging in corporate misconduct including self-dealing, misappropriation, breach of fiduciary duty and corporate waste.
