The NY Times reports that BS&F's victory in the Tennessee trial of Genesco, Finish Line and UBS arising out of a failed attempt by the latter two to repurdiate a merger. Columnist Floyd Norris singles out the Court's findings that the key defense witness (cross-examined by BS&F partner Jonathan M. Shaw), who claimed that Genesco and its bankers had defrauded the purchasers, lacked credibility. "A lawyer for Genesco, Michael Brille, a lawyer with Boies, Schiller & Flexner, said Genesco argued that it was the sudden change in the credit markets that led UBS to want to get out of its commitment."
