Class Certification Denied in Antitrust Action Against Funeral Industry

BSF won a victory for clients Batesville Casket Co. and Hill-Rom Holdings, Inc. when United States District Judge Kenneth Hoyt in Houston denied class certification in two related antitrust cases attacking Batesville's sales and distribution policies. In a week-long evidentiary hearing, BSF demonstrated that the proposed plaintiff classes, which together sought hundreds of millions of dollars in alleged damages, did not satisfy the requirements of Rule 23 and that class certification should therefore be denied.
