American Airlines was denied a preliminary injunction against a former sales executive accused of bringing trade secrets to Delta Airlines. BS&F partner Harlan Levy successfully argued that without a noncompete agreement, American had no grounds to prevent or limit the sales executive’s active employment at Delta.
