BSF Brings Antitrust Claims Against Seed Giant Monsanto


BSF managing partner Donald L. Flexner is leading a team of lawyers representing E.I. DuPont Nemours & Co. and Pioneer Hi-Bred International Inc. in bringing claims against Monsanto for monopolization of the genetically modified soybeans and corn markets and emerging markets involving stacked traits. After Monsanto brought charges against DuPont and Pioneer in May 2009, alleging patent infringement, BSF countersued on behalf of the client in July 2009 with claims of patent fraud and antitrust violations. The Department of Justice has also opened an investigation into Monsanto's practices.
