False Claims Act
Boies, Schiller & Flexner's False Claims Act practice offers clients the counsel of attorneys who have successfully tried and won cases against some of the largest corporations in the world. The practice draws on the experience of firm lawyers throughout the United States and is directed from our New Jersey office by a partner with over a decade managing False Claims Act cases. We also work closely with Government prosecutors and agencies on both the federal and state levels. The Firm represents whistleblowers in significant matters, sometimes on a contingent basis in appropriate cases where potential damages exceed $50 million.
Our recent cases and recoveries include:
- U.S. ex rel Piacentile v. Medco -- a case prosecuted by the United States Government and several state governments against the largest pharmacy benefit manager in the United States. The United States Government and certain of the state government's plaintiffs settled the matter for $192 million.
- United States of America ex rel James Thompson, et al. v. Columbia/HCA -- litigation resulting in $1.7 billion of civil and criminal settlements being paid to the United States.
- U.S. ex rel MANA v. Allina -- a non-intervened case against Allina Healthcare Corporation, one of the largest health maintenance organizations in the Midwest, as well as five hospitals and 65 anesthesiologists. Boies, Schiller & Flexner's clients reached a significant confidential settlement on the eve of trial.
Currently, the Firm represents a number of relators in significant False Claims Act matters relating to healthcare, defense contracting and other government contracts, although the specifics remain under seal and cannot be disclosed at this time.
