Anne M. Nardacci

Anne advises clients in high-stakes complex commercial litigation. She maintains a focus on antitrust litigation and represents plaintiffs and defendants in a broad range of industries and actions in federal and state courts. Her expertise includes class actions, opt-out litigation, multidistrict litigation, and appellate litigation.

Anne consistently achieves outstanding results for her clients, which include those in the high tech, health care, and food industries, among others. She has recovered hundreds of millions of dollars for corporate plaintiffs that have been victims of various price-fixing cartels. For defense side clients, she has achieved the dismissal of a wide variety of antitrust claims and obtained class certification rulings favorable to her clients.

Clients also regularly seek antitrust counseling and strategic advice from Anne on a variety of compliance and go-to-market issues. Her experience includes representing clients undergoing investigations by federal and state antitrust enforcement agencies, and she has served as outside counsel to state Attorneys General prosecuting antitrust enforcement actions.

Committed to leadership in her field, Anne is also a member of the Executive Committee of the New York State Bar Association’s Antitrust Section, and a former member of the Governor’s Judicial Screening Committee for the New York State Third Department.

Selected matters include:

• Representing a medical device manufacturer in an antitrust action alleging anti-competitive practices against a competitor

• Representing corporate opt-out plaintiffs that were victims of a price-fixing cartel involving broiler chickens in coordinated proceedings against major broiler chicken suppliers

• Representing consumer plaintiffs and putative classes in a series of class actions alleging violations of the bankruptcy code related to credit reporting, achieving over $25 million in settlements to date in the ongoing litigation and a favorable ruling from the Second Circuit on a key arbitration issue

• Representing corporate opt-out plaintiffs that were victims of a price-fixing cartel involving LCD panels, achieving total settlements of more than $550 million

• Representing corporate opt-out plaintiffs that were victims of a price-fixing cartel involving Cathode Ray Tubes (CRTs) used in televisions and computer monitors, achieving total settlements of more than $250 million and the reversal of a $70 million adverse trial court ruling from the Ninth Circuit

• Defending the Andy Warhol Foundation for the Visual Arts and the Andy Warhol Art Authentication Board in antitrust litigation; after more than three years of litigation, the plaintiff voluntarily dismissed all claims and achieved no recovery

• Defending a major funeral products manufacturer in antitrust litigation brought against it in two related class actions; achieved defeat of class certification and a successful outcome for the client
