Duane represents clients in complex commercial litigation, with a particular focus on restructuring disputes, contested issues in bankruptcy, and cross-border litigation. An experienced trial lawyer, Duane is regularly called upon to provide courtroom leadership for creditors, institutional shareholders, and fund principals in cases where litigation drives recoveries. Both the New York Law Journal and Law360 have named him a “Rising Star,” and his cases are featured regularly in Reorg Research, Bloomberg, and the Wall Street Journal.

In the area of restructuring litigation, Duane has represented ad hoc groups of creditors in a number of significant corporate bankruptcies, including the Chapter 11 cases of Intelsat S.A. and LBI Media, in each case serving as trial counsel in multi-week hearings on contested plans of reorganization.

In cross-border disputes, Duane has helped recover billions of dollars for institutional shareholders, including through Section 1782 discovery proceedings that have led to precedent-setting decisions in district and appellate courts throughout the United States.

  • Representing mezzanine lender in high-profile litigation to decide ownership of the Crowne Plaza Hotel in Times Square
  • Representing Ad Hoc Group of Hertz European noteholders in litigation to recover backstop financing fees
  • Multiple Section 1782 proceedings in support of appraisal litigation in the Cayman Islands, Bermuda, and Japan
  • Representing Ad Hoc Group of Convertible Noteholders in Chapter 11 of Intelsat, S.A.
  • Successfully prosecuting an international arbitration against Greece, resulting in a settlement worth over €1 billion for foreign investors
  • Defending litigation arising from the Cayman Islands provisional liquidation of the Abraaj Group, a Dubai-based private equity firm
  • Defending fraudulent transfer claims in Chapter 15 adversary proceedings brought by the trustee of Norske Skogindustrier, an insolvent Norwegian paper company
  • Representing second-lien noteholders in Chapter 11 adversary proceeding against Spanish-language broadcaster LBI Media Inc.
  • Advising creditors of Puerto Rico’s Employee Retirement System, in connection with the Title III restructuring proceedings and related litigation against the U.S. and Puerto Rico under the Takings Clause
