Bob’s extensive experience includes successfully representing clients in complex commercial litigation and governmental investigations, and counseling global companies on their most challenging and significant business issues. His particular focus on–and expertise in–antitrust and competition matters leads clients to seek his judgment and strategic advice on mergers, acquisitions, and other business transactions.

Throughout his tenure at the firm, Bob has represented clients in a wide variety of industries, including airlines, agribusiness, banking, health care, health insurance, health care technology, insurance/reinsurance, Internet, payment systems, private equity, sports media, and telecommunications. He has served as lead or co-lead counsel before a number of federal and state courts, in arbitration proceedings and mediations, and before the U.S. Department of Justice, the Federal Trade Commission, the Federal Communications Commission, the Securities and Exchange Commission, and state Attorneys General.

Prior to joining the firm in 2003, Bob was associated with another prominent Washington, D.C., firm where his practice included commercial litigation and arbitration, representation of various telecommunications and media firms before the Federal Communications Commission, and securing regulatory approval of several major mergers.

Bob is frequently quoted on competition matters in national and international media.

  • Secured antitrust clearance for multiple transactions in the airline industry
  • Secured antitrust clearance for the consolidation of two major health care systems into an $11 billion organization
  • Serving as lead trial and appellate counsel in FTC v. Sanford Health and Mid Dakota Clinic (federal court and administrative merger challenge)
  • Leading the firm’s representation of Cogent Communications on competition and regulatory issues in the U.S. and Europe, and before the DOJ and FCC in connection with the proposed Comcast/Time Warner Cable and AT&T/DirecTV mergers
  • Secured antitrust clearance for major health system’s acquisition of one of the nation’s largest providers of senior care and services
  • Representing a Chinese manufacturer in connection with U.S. antitrust issues associated with the acquisition of a competitor
  • Representing a major health care technology company in connection with numerous competition and other issues
  • Leading the firm’s representation of an integrated health system in connection with competition and related issues
  • Representing American Express in antitrust litigation against Visa, MasterCard and several banks in which AmEx obtained a record-breaking settlement in excess of $4 billion, and defending AmEx against DOJ and private claims alleging violations of Sections 1 and 2 of the Sherman Act
  • Representing an international private equity firm in an SEC investigation
  • Leading the firm’s defense of six companies in litigation alleging breach of licensing agreements and prosecution of antitrust counterclaims (confidential settlement)
  • Serving as co-lead trial counsel in defending a Fortune 100 company in a multi-hundred million-dollar arbitration alleging breach of a technology licensing agreement and tortious interference (no relief awarded to claimants)
  • Defending Delta Air Lines in a lawsuit challenging its merger with Northwest Airlines, and representing Delta in connection with the DOJ’s review of that merger
  • Leading the firm's internal investigation for Bermuda-based reinsurer RenaissanceRe, and representing the non-executive members of the Board in connection with related governmental investigations
