Mark’s practice focuses on class actions, antitrust, data privacy, the First Amendment, and intellectual property. He has resolved over 500 cases in litigation, and is highly regarded by both the defense and plaintiffs’ attorneys. Companies look to Mark as a trusted advisor and litigator in new areas of the law and emerging technologies, including artificial intelligence, autonomous vehicles, shared/gig economies, real-time targeting technologies, digital media and ads, augmented and virtual reality, blockchain technology, and security software and hardware. He has been the architect and lead of some of the country’s most important and closely watched cases.

Mark is one of the firm’s first chairs in high-stakes consumer and antitrust litigation against Google, where he successfully obtained three separate national class certifications. These included certification of antitrust claims on behalf of a national class of online publishers, and two contested certifications for privacy misuse – which created law and precedent that were the first of their kind. Mark then obtained a $425 million trial verdict against Google in September 2025 in one of these cases. Currently, he leads a number of arbitrations for Fortune 100 companies against Google over antitrust disputes relating to tens of billions of dollars spent on Search Ads.

On the defense side, Mark defeated the first European General Data Privacy Regulation (GDPR) class action in the U.S., styled as Elliott v. PubMatic, involving a large adtech platform. He also prevented class certification against Telsa, on tens of thousands of Fair Credit Reporting Act claims, from its acquisition of Solar City. Mark is one of Delta Air Lines’ leads for lawsuits arising from the largest cybersecurity outage in history, including Delta Air Lines v. CrowdStrike, where Delta is claiming hundreds of millions in damages against CrowdStrike. Mark also currently defends the Attorney General of Maryland, on various issues relating to state laws and the First Amendment, in NetChoice v. Brown.

Mark was previously an IT consultant at Arthur Andersen Consulting LLP, implementing database software. Mark is a proud first-generation immigrant from Taiwan and is fully fluent in Mandarin Chinese. He has been a close advisor to U.S. presidential candidates, congress members, and state governors and policy makers, and been at the center of some of the most cutting edge federal and state legislation relating to data and AI-technologies.

Some of Mark's recent notable cases include:

  • Currently represents renown broadcaster and podcaster David Greene, for Google’s use of his voice as the AI-voice of the Notebook app
  • Currently leads a number of arbitrations for Fortune 100 companies against Google over antitrust disputes relating to tens of billions of dollars spent on Search Ads
  • Currently representing a class of over a hundred million consumers in an antitrust case relating to general search engines against Google, in Crowell v. Google
  • Currently leads the largest mass action in U.S. history, relating to AI-training data and the Incognito Mode on Chrome, against Google in Luna v. Google
  • Currently defends the Maryland Attorney General, in a First Amendment challenge brought by NetChoice, for Maryland’s online Kids Code legislation
  • Currently defends a life insurance company and a health savings account provider, in two separate large data breach cases involving alleged loss of consumer data
  • Currently is lead counsel for a coalition enforcing Daniel’s Law in the State of New Jersey for police officers and their families, in over a hundred cases against various online data brokers
  • Currently represents a class of consumers in an antitrust and RICO case against class action administrators and banks, for price fixing and suppressing class action payouts
  • Currently representing Delta Air Lines in various matters relating to the CrowdStrike faulty software update outage, including Delta Air Lines v. CrowdStrike
  • Obtained class certification and summary adjudication in the publisher antitrust case against Google, In re Google Publisher Antitrust Litigation
  • Obtained a $425 million jury verdict in a nationally certified privacy class action against Google, in Rodriguez v. Google (on “Web & App Activity”)
  • Obtained a settlement against Alphabet in a nationally certified privacy class action against Google (Brown v. Google on “private browsing”), resulting in the deletion of data, with a reported value of billions of dollars
  • Defeated a set of Fair Credit Reporting Act cases against Tesla, by successfully compelling individual arbitrations and upholding the motions despite appeal
  • Defeated the first European General Data Protection Regulation (GDPR) filed in the United States, against one of the U.S.’s largest online advertising platforms, by dispositive motion
  • Defeated by motion for summary judgment a California class action alleging illegal recording of data, carrying potential liability over nine figures in alleged damages
  • Defeated two plaintiff companies seeking over $75 million on dispositive motions, for the alleged failures of crypto-certificates relating to tens of thousands of payment terminals
  • Obtained a “no action” letter from regulators, in a matter involving over six million database records potentially compromised
  • Prevailed on summary judgment in a landmark trademark case on concurrent use, in a dispute between two of the U.S.’s most recognized brands involved in connected cars and car sharing
  • Obtained a favorable resolution in a dispute involving the cyberhack of an initial cryptocurrency offering on a social media platform
  • Obtained favorable resolution against over a dozen business claimants, who alleged that they were substantially overcharged for years of targeted advertising services, involving tens of millions of transactions
  • Defeated class certification in a precedential data misuse class action involving driver and vehicle data, which could have negatively affected the ability to use millions of public records nationwide
  • Obtained dismissals in a competitor patent litigation involving mechanical patents, partly by collateral IPR proceedings
  • Obtained dismissal with prejudice on motions to dismiss brought by an alleged class of millions of users seeking billions of dollars in statutory damages, in a data misuse class action involving sound-based beacon technology for one of basketball’s favorite teams
  • Obtained a dismissal, without filing motions to dismiss, in one of the Southern United States’ largest data breaches allegedly involving over six million vote records
  • Obtained a release without payment, in Telephone Consumer Protection Act litigation involving one of U.S. broadband carriers, where billions of dollars were at issue
