Boies Schiller Flexner represents Chipotle Mexican Grill, Inc. in connection with recovering misdirected rent payments for Chipotle’s locations at Washington, D.C.’s Union Station.
Last week, BSF filed a non-party motion requesting an order directing the parties to file public versions of certain documents related to a settlement between Amtrak and Rexmark. Amtrak took control of Union Station from Rexmark last year pursuant to a judgment granting Amtrak immediate possession. However, Chipotle continued paying rent to Rexmark, its former landlord. Rexmark has retained more than $440,000 of Chipotle’s rent payments, which Chipotle seeks to recover. Amtrak and Rexmark disagree about which entity should refund duplicate payments to Chipotle.
The Washington Business Journal reported on the case, quoting partner Scott Gant. “The outcome directly affects not only the management of one of the nation’s most prominent transportation hubs, but also the rights of numerous tenants who operated retail and restaurant establishments at Union Station,” the motion stated. “The practical need for public access is illustrated by Chipotle’s current situation: it has paid rent to both Investco and Amtrak, each of which (apparently) claim entitlement to the funds.”
