In a closely watched dispute between the New York Yankees and the country’s largest ticket reseller, StubHub, BSF won a court order preventing StubHub from opening a storefront near Yankee Stadium days before the start of the 2013 Major League Baseball Season. Managing Partner Jonathan Schiller appeared on behalf of the Yankees in New York State Supreme Court in the Bronx, arguing that the store would violate the New York Arts & Cultural Affairs Law, which protects venues such as Yankee Stadium by prohibiting certain ticket resale activity within 1,500 feet of the venue. Weil, Gotshal appeared on behalf of StubHub and argued that StubHub was “only a website” and exempt from the law, but the Court disagreed and issued a temporary restraining order. StubHub and the Yankees entered into a confidential settlement shortly after BSF won the temporary restraining order.
