In Law.com’s Class Actions: Critical Mass column, Boies Schiller Flexner partner Scott Gant shares his take on the U.S. Supreme Court’s recent decision to dismiss Laboratory Corporation of America Holdings v. Davis, a case involving blind patients who claimed LabCorp’s kiosks violated the Americans with Disabilities Act. LabCorp contended the class lacked Article III standing, arguing the plaintiffs hadn’t suffered actual injuries.
“As someone who represents both plaintiffs and defendants in class actions, I was glad the court dismissed the petition in this case. The case was not a good vehicle to address the series of issues raised by ‘uninjured class members.’ I hope when the court ultimately revisits it, the court will have the benefit of a clear and precise presentation of those issues,” said Gant.
