FTC's latest effort to regulate lawyers hits wall of opposition

For the past eight years, the Federal Trade Commission has pushed for greater regulation of the legal profession, drawing ire from the American Bar Association and rebukes from federal judges. Now, the agency is back in court trying to salvage rules that would force lawyers to detect, combat and report identity theft. On Nov. 15, the U.S. Court of Appeals for the D.C. Circuit — which has already batted down one FTC lawyer regulation effort — will hear arguments in a fight over the so-called "Red Flags Rule."
