For more than two decades, Eric has successfully represented small and large clients in complex commercial matters, including intellectual property and antitrust actions. He excels at analyzing complex issues—often with a high-tech component—and translating that analysis into practical advice, effective litigation strategies, and persuasive advocacy.

Eric represents both plaintiffs and defendants before trial and appeals courts. He obtained a patent infringement jury trial verdict for an educational software provider; the case was one of the five intellectual property actions included in the New York Law Journal’s “Verdicts Hall of Fame,” which recognized New York civil verdicts from 2000-2018. He obtained a preliminary injunction for a leading innovator in women’s health based on trade secret misappropriations. He also successfully defended a Big Four tech company against patent infringement claims related to streaming video, obtaining non-infringement judgments on patents others in the industry had previously licensed.

In addition to trying cases before trial and appeals courts, Eric practices before the International Trade Commission and the Patent Trial and Appeal Board. He also has substantial experience leading due diligence projects and licensing negotiations on behalf of high-technology companies seeking to penetrate markets and monetize their intellectual property.

Eric taught “Patent Enforcement” at The George Washington University Law School for over a decade. He was a partner at the firm from 2007-2012, when he left to start his own law firm. He rejoined the firm in 2016.

Eric’s representative matters include:

  • Obtained a preliminary injunction for a leading innovator in women’s health based on alleged trade secret misappropriations by an overseas competitor of proprietary technology used in mammography systems; the case began as a breach of contract action, and after discovering evidence of a possible misappropriation, we moved for expedited discovery and, within three months, obtained the injunction
  • Co-led a patent infringement action brought by a provider of content filtering software to schools, resulting in a jury verdict that was included as one of the five IP verdicts in the New York Law Journal’s “Verdicts Hall of Fame,” which recognized New York civil verdicts from 2000-2018
  • Led the defense of a leading e-commerce company against claims of patent infringement related to streaming video, resulting in judgments of non-infringement on three patents and voluntary dismissals with prejudice on the two remaining patents (upheld on appeal)
  • Led the defense of advertising company against claims of patent infringement, resulting in a judgment of non-infringement (upheld on appeal)
  • Represented a major LCD manufacturer in a patent infringement lawsuit, resulting in a jury verdict of $50 million for willful patent infringement on behalf of client (case settled after verdict)
  • Represented a major LED manufacturer as complainant before the International Trade Commission, resulting in the Commission finding that respondents violated section 337 of the Tariff Act of 1930 by reason of patent infringement and issuing an exclusion order prohibiting the importation of respondent’s LEDs (case settled after appeal)
  • Defended a leading manufacturer of digital cameras and scanners against claims of patent infringement related to a data communication standard, resulting in a summary judgment of non-infringement (upheld on appeal)
