The Florida District Court of Appeal affirmed a trial court's dismissal of a shareholder's securities fraud class action against Tyco International Ltd. as untimely. The court of appeals ruled that the plaintiff's claims were not tolled by the previously filed class action against Tyco because his claims were not identical to the class claims.
