Partner Nicola Bonante and counsel Tiziana De Virgilio published an article in Il Sole 24 Ore titled “Le nuove frontiere dei patti di non concorrenza: tra tutela della competitività e ‘prigione’ delle competenze” (“The New Frontiers of Non-Competition Agreements: Between Protecting Competitiveness and the ‘Prison’ of Skills”).
The article examines the evolving role of non-compete agreements in today’s labor market, balancing competitiveness, and talent mobility. Drawing on recent empirical research and case law, the article highlights how the increasingly widespread use of non-compete clauses — both in Italy and the U.S. — may have a distorting effect on labor mobility, wage dynamics, and overall market efficiency.
