Boies Schiller Flexner filed an amicus brief in the U.S. Supreme Court on behalf of Professor Andrew Flores, a leading scholar and researcher on public policy concerning the LGBTQ+ community.
The firm partnered with The Williams Institute at UCLA School of Law to draft the brief in support of the plaintiffs, who are challenging a West Virginia law that bars transgender girls from participating on girls’ sports teams. The amicus brief focused on the concept of “political powerlessness” in Equal Protection Clause jurisprudence, presenting empirical data demonstrating that the transgender community satisfies all indicia of “political powerlessness” such that heightened scrutiny of discriminatory government treatment is warranted.
