The firm secured an early victory on behalf of renowned radio and podcast personality David Greene in his lawsuit against Google over the alleged unauthorized use of his voice and identity in the company’s AI-powered NotebookLM product.
The U.S. District Court for the Northern District of California granted Greene’s motion to remand the case to California state court, rejecting Google's argument that his claims were governed exclusively by federal copyright law.
Greene alleges that Google misappropriated his voice, likeness, and identity through NotebookLM's synthesized voice feature, asserting claims for right of publicity, unfair competition, and unjust enrichment. In granting remand, the court found that the claims are based on the alleged misuse of Greene's personal attributes, rather than the copying of copyrighted recordings.
This is believed to be among the first decisions of its kind in the AI space.
